Terms & Conditions

DEFINITIONS

The “Seller” is defined as the legal entity Pelynoobakes. The “Buyer” means the person (legal or natural) who buys the goods. “Goods” is defined as the items to be supplied by the Seller to the Buyer as listed in this invoice.

GENERAL

These Terms and Conditions shall apply to the sale of the Goods by the Seller to the Buyer to the exclusion of all other terms and conditions referred except where the Seller has agreed to such variation in writing and by way of signature. By ordering from Pelynoobakes you agree to be legally bound by these Terms and Conditions (“Conditions) and accept that these Conditions may be modified or amended and posted on this website from time to time.

CANCELLATIONS

We reserve the right to cancel an order should the Buyer behave in an abusive, unreasonable or threatening manner. Order cancellations are not allowed once Payment has been made. We do not offer refunds for any orders that have been placed incorrectly. No refunds will be made for payments that were incorrectly paid to the wrong account.

PRODUCT INFORMATION

The images on the website are examples of our products. All our products are hand made and may have variations from the website image.

AMENDMENTS TO YOUR ORDER

If you have any queries or need to make any changes to an order please contact us immediately. Order amendments must be submitted in writing (through email or Whatsapp). We will assess the request for an amendment, and endeavour to make concessions where possible dependant on the request and amount of notice given.

DAMAGES

In the unlikely event that your order arrives damaged, it is the customer’s responsibility to report the damage to us within 48 hours and send photographic evidence of the damage within 48 hours if you wish to claim a refund or replacement. The Seller will not take back any undamaged goods from the Buyer unless agreed in writing by the Seller. The Seller accepts no liability for bakes that are damaged after they have been delivered to the agreed location.

Any description applied to the Goods is only given by way of identification and does not constitute a sale by description. Any image provided as part of the description of similar goods is given for illustrative purposes only. Given the nature of the goods, minor variations of colour and design may apply.

ALLERGIES AND SPECIAL DIETARY REQUIREMENTS

Please discuss any allergies or special dietary requirements with us before making payment. Our products may not be suitable for those with certain allergies as our kitchen does handle wheat and nuts.

DELIVERY & RESCHEDULING

We cannot be held liable for any damages to the products once they have delivered to the Buyer. If there are discrepancies or defects in your order, it is the customer’s responsibility to report the damage to us within 48 hours and send photographic evidence of the damage within 48 hours if you wish to claim a refund or replacement. After 48 hours from the point of delivery, we cannot be held liable for any errors in your order.

We will always endeavour to deliver within the given time slot, however unfortunately delivery timings can not be guaranteed. Refunds will not be given for delayed deliveries. If in the unlikely event the delivery is delayed, we will always endeavour to deliver the product to you as close as possible to the given delivery time.

If your order has been delivered according to the instructions left in your Order Notes, we cannot be held liable should the Goods be damaged due to external factors thereafter. If no one is home to receive the Goods, it will be placed outside your door/gate (as stated in our F.A.Qs). If the Courier is somehow unable to place the cake outside your door/gate, and if the Buyer remains uncontactable, the Buyer will have to pay for the $8 redelivery fee (subject to availability of slots).

If rescheduling is not possible within 2 weeks, your Order will be disposed of, to avoid violating health & safety hazards.

COMPLAINTS

If you wish to make a complaint to us or let us know any concerns after receiving the Goods, please do so in writing. Evidence of any faults, damages or discrepancies should be included. Any refunds will be given entirely at our discretion.
